Terms of Service
Effective: October 1, 2026
1. Agreement
These Terms of Service govern your use of the AffirmReady website and software (the "Service"), provided by AffirmReady LLC, a Michigan limited liability company ("AffirmReady," "we," "us"). By creating an account or using the Service, you agree to these Terms on behalf of yourself and the organization you represent. If you do not agree, do not use the Service.
2. What the Service Is
AffirmReady is a software tool that helps organizations prepare for and organize their Cybersecurity Maturity Model Certification (CMMC) Level 1 self-assessment and the safeguarding requirements of FAR 52.204-21. The Service provides guided walkthroughs, an evidence register, policy templates, and reminders. Some plans include guided Microsoft 365 self-checks that explain how to review your own settings.
The Service does not store your evidence files. Your evidence stays in your systems, and the evidence register records only what each item is, who owns it, when to review it, and where you keep it. The Service does not connect to, sign in to, or scan your Microsoft 365, Google Workspace, or other systems.
3. No Legal Advice, Certification, or Assessment
The Service is an organizational and educational tool only. AffirmReady does not provide legal, compliance, or consulting advice. AffirmReady is not a CMMC Third-Party Assessment Organization (C3PAO), Registered Provider Organization, or government agency, and is not affiliated with or endorsed by the U.S. Department of Defense or The Cyber AB.
Using the Service does not certify, verify, or guarantee that your organization meets any contractual, regulatory, or CMMC requirement. Any readiness summary, status, or report generated by the Service reflects only the information you enter.
4. Your Responsibility for Affirmations
You are solely responsible for determining whether your organization meets applicable requirements and for the accuracy of any self-assessment result or annual affirmation you submit to the Supplier Performance Risk System (SPRS) or any government or prime contractor. Affirmations are legal statements made by your organization, not by AffirmReady. You should consult qualified legal counsel or a cybersecurity professional before submitting any affirmation.
5. Prohibited Information: No CUI
The Service is designed for Federal Contract Information (FCI) readiness only. You must not enter Controlled Unclassified Information (CUI), classified information, export-controlled technical data (including ITAR or EAR data), or any information whose handling requires CMMC Level 2 or higher in any field, note, or evidence register entry. If you handle CUI, your organization likely requires CMMC Level 2, which the Service does not support. AffirmReady may remove content it reasonably believes violates this section.
6. Accounts, Users, and Security
You must provide accurate account information and keep it current. Every account must use multi-factor authentication with an authenticator app, and you must store your recovery codes securely. Keep your credentials confidential and notify us promptly at support@affirmready.com of any unauthorized access.
The account owner may invite other users and assign them Owner, Editor, or Read-only access. You are responsible for all activity under your account, for the users you invite, and for removing access for users who no longer need it.
7. Subscriptions, Free Trials, and Billing
The Service is offered on monthly subscription plans at the prices shown at checkout. Payments are processed by Stripe; AffirmReady does not store full card or bank account numbers.
If you start a free trial, you will provide a payment method at signup. Unless you cancel before the trial ends, your subscription begins automatically, and your payment method is charged the plan price. We will remind you before the trial ends.
Subscriptions are renewed each month automatically until canceled. By subscribing, you authorize recurring charges to your payment method. Prices exclude applicable taxes, which will be added where required. We may change prices with at least 30 days’ notice, effective at your next renewal.
8. Plan Changes, Cancellation, and Refunds
You may upgrade, downgrade, or cancel at any time through the billing portal in your account. Cancellation takes effect at the end of the current billing period, and you keep access until then. Except where required by law, fees already paid are non-refundable, including for partial months.
If a payment fails, we will retry it and notify you. If payment is not resolved, we may suspend or cancel your subscription. Billing questions go to support@affirmready.com.
9. Your Data
You own the information you enter the Service, including assessment answers, evidence register entries, notes, and links to where your evidence is kept ("Customer Data"). Links you add may point to your own systems; AffirmReady does not access the content behind them. You grant AffirmReady a limited license to host, process, and display Customer Data only to provide and support the Service. We handle Customer Data as described in our Privacy Policy. You may export your Customer Data while your account is active and for 30 days after cancellation, after which we may delete it.
10. Acceptable Use
You will not: misuse or attempt to gain unauthorized access to the Service or other customers’ data; attempt to bypass multi-factor authentication or other security controls; upload or submit malware; reverse engineer the Service except where law allows; resell the Service without our written permission; or use the Service to make false statements to any government agency or contractor.
11. Intellectual Property
AffirmReady owns the Service, including its software, workflows, templates, guides, and content, excluding Customer Data. Subject to these Terms, you may use templates and documents generated by the Service for your organization’s internal business purposes, including after your subscription ends.
12. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, AFFIRMREADY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AFFIRMREADY DOES NOT WARRANT THAT USE OF THE SERVICE WILL RESULT IN ANY CONTRACT AWARD, PASSING ASSESSMENT, OR REGULATORY OUTCOME, OR THAT GUIDANCE REFLECTS THE MOST CURRENT REGULATORY TEXT.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, AFFIRMREADY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST CONTRACTS, GOVERNMENT PENALTIES, OR CLAIMS ARISING FROM ANY AFFIRMATION YOU SUBMIT. AFFIRMREADY’S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE FEES YOU PAID IN THE 12 MONTHS BEFORE THE CLAIM AROSE.
14. Indemnification
You will defend and indemnify AffirmReady against third-party claims arising from your Customer Data, your breach of these Terms, or any self-assessment, result, or affirmation your organization submits.
15. Suspension and Termination
We may suspend or terminate your access if you breach these Terms, fail to pay, or enter prohibited information. You may stop using the Service at any time. Sections 3, 4, 9 through 14, and 16 survive termination.
16. Governing Law and Disputes
These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law rules. Any dispute will be brought exclusively in the state or federal courts located in Kent County or Ottawa County, Michigan, and both parties consent to that jurisdiction.
17. Changes and Contact
